If you are dissatisfied with the products purchased from nuovaidea.ro and want to cancel the order and implicitly receive your money back, you can apply for the product return procedure within 15 calendar days, according to the provisions of Emergency Ordinance no. 34/2014, regarding consumer rights within contracts concluded with professionals, as well as for the amendment and completion of certain normative acts.
Distance contract means the contract for the supply of products or services concluded between a trader and a consumer, within a sales system organized by the trader, which exclusively uses, before and upon conclusion of this contract, one or more distance communication techniques.
The right of return within 15 calendar days is only addressed to customers who purchased products online from the nuovaidea.ro website.
The customer has the right to unilaterally terminate the distance contract, within 15 calendar days, without penalties and without giving any reason.
The right to withdraw from the purchase does not apply to legal entities.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement, for example, a letter sent by post, fax or e-mail.
For this purpose, you can use the withdrawal model, but its use is not mandatory.
You can also send an e-mail to office@nuovaidea.ro or any other unequivocal statement, with all the information from the above-mentioned form. If you use this option, we will send you without delay, on a durable medium, for example by e-mail, confirmation of receipt of the withdrawal request.
We may postpone the refund until the date we receive the products back or until you provide us with proof that you have sent the products back, whichever is the earliest.
The 15 calendar day period provided for exercising this right begins to run:
- a) the day on which the consumer or a third party, other than the carrier and indicated by the consumer, takes physical possession of the products, in the case of sales contracts, or:
(i) if the consumer orders multiple products in a single order that will be delivered separately, the day on which the consumer or a third party, other than the carrier and indicated by the consumer, takes physical possession of the last product;
(ii) in the case of delivery of a product consisting of several lots or pieces, the day on which the consumer or a third party, other than the carrier and indicated by the consumer, takes physical possession of the last product or the last piece;
Omission of information regarding the right of withdrawal
If nuovaidea.ro has not sent the consumer information regarding the right of withdrawal according to the provisions of GEO 34/2014, the withdrawal period expires 12 months after the end of the initial withdrawal period of 15 calendar days.
If nuovaidea.ro has sent the consumer information regarding the right of withdrawal within 12 months from the date on which the products/services are considered delivered, according to the mentions in the section above, the withdrawal period expires within 15 calendar days from the date on which the consumer receives the respective information.
The obligations of nuovaidea.ro in the event of withdrawal
nuovaidea.ro reimburses all amounts received as payment from the consumer, including, where applicable, delivery costs, without undue delay and, in any case, no later than 14 days from the date on which it is informed of the consumer's decision to withdraw from the contract in accordance with the provisions of the law.
nuovaidea.ro reimburses the amounts mentioned above using the same payment methods as those used by the consumer for the initial transaction, unless the consumer has agreed to another payment method and provided that the consumer is not responsible for paying commissions following the reimbursement.
Without prejudice to the first paragraph of this section, nuovaidea.ro is not obliged to reimburse additional costs if the consumer has explicitly chosen a type of delivery other than the standard delivery offered by nuovaidea.ro.
Unless nuovaidea.ro has offered to recover the products itself, in the case of sales contracts, nuovaidea.ro may postpone the reimbursement until the date of receipt of the products that were the subject of the sale or until the moment of receiving proof from the consumer that he sent the products to nuovaidea.ro, taking into account the earliest date.
Consumer obligations in case of withdrawal
According to Ordinance no. 34/2014, the consumer bears only the direct costs related to the return of the products, unless nuovaidea.ro agrees to bear those costs or nuovaidea.ro has not informed the consumer that these costs must be borne by the consumer. In the case of off-premises contracts, where the products were delivered to the consumer's home at the time of conclusion of the contract, nuovaidea.ro takes over the products at its expense if the products, by their nature, cannot be returned normally by post.
Exceptions to the right of withdrawal
The following are exempt from the right of withdrawal, with regard to distance contracts and off-premises contracts:
– providing products made according to the specifications presented by the consumer or clearly personalized;
– supplying products that are likely to deteriorate or expire quickly;
– the supply of sealed products that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer;
– the supply of products which, after delivery, are, according to their nature, inseparably mixed with other elements;
– the supply of sealed audio or video recordings or sealed computer programs that have been unsealed after delivery;
– the supply of digital content that is not delivered on a material medium, if the provision has begun with the consumer's express prior consent and after he has confirmed that he has become aware of the fact that he will lose his right of withdrawal.
